The most important factor is determining whether another person or business was negligent. A person who was unreasonably careless can be considered negligent and in breach of a legal duty. This gives way to a personal injury claim.

Have you lost a loved one due to negligence? Families of wrongful death victims should schedule an initial consultation immediately with a wrongful death attorney. The Law Offices of L. Clayton Burgess has vast experience in successfully defending the rights of survivors of wrongful death. An experienced wrongful death attorney can provide you with an initial consultation FREE of charge to you regardless of whether you retain our services.

Wrongful death suits are filed when the wrongful conduct of a person or entity results in the death of another person. Like personal injury, this area of tort can involve every area of tort practice, but your first step should be to consult with an experienced wrongful death attorney.

We know about the emotional trauma, the strain on the family and the economic hardship wrongful death causes. The four elements of wrongful death include:

the conduct of the individual caused the victim’s death;
the individual was negligent or strictly liable for the victim’s death;
the victim has surviving family or beneficiaries;
the victim’s death resulted in financial damages.

If all of these elements are present, the family will have the legal standing necessary to file a wrongful death lawsuit. While a wrongful death lawsuit will not bring back their loved one, this lawsuit can help the family make certain they are financially stable after their loved one’s untimely demise.

Louisiana’s statute of limitations for wrongful death gives one year to file a wrongful death claim in court, usually starting from the date of the deceased person’s death.

Our Louisiana wrongful death attorneys at the Law Offices of L. Clayton Burgess are specialists in this field. We will meticulously investigate the case and ensure all of the facts of the case are presented to the court in a clear and concise manner. Since the burden of proof is the responsibility of the victim’s family, it is essential to act quickly.

An experienced wrongful death attorney is your advocate and can fight to ensure you and your family receive the compensation you deserve.
